Abstrak

The handling of children who face legal problems, especially the abuse of narcotics by children, must prioritize or prioritize the best interests of the child. Children must be protected so they do not become victims either directly or indirectly. experience losses both mentally, physically and socially due to the actions of a person or group of people. With the existence of Law of the Republic of Indonesia Number 11 of 2012 concerning the Juvenile Criminal Justice system, it provides a strong legal basis to differentiate the treatment of children who are in conflict with the law. Legal treatment of minors in cases of narcotics abuse deserves special attention from the enforcement apparatus. the law in processing and deciding the decisions that will be taken to regulate and restore the future of the child as a responsible citizen in society.The application of material criminal sanctions against criminal cases of narcotics abuse committed by minors still refers to Article 127 paragraph (1) letter a of the Narcotics Law, with the threat of imprisonment for 12 years. However, it should also be borne in mind that Article 81 paragraph (2) of Law Number 11 of 2012 concerning the Criminal Justice System for Children is written as imprisonment that can be imposed on children for a maximum of 1/2 (one half) of the maximum threat of imprisonment for adults. Therefore, the maximum threat of criminal acts of narcotics abuse by children must be under 6 years.The implementation of penalties for minors of narcotics abuse offenders is still in accordance with the provisions of Law no. 35 of 2014, concerning child protection and Law no. 03 of 1997, concerning the juvenile criminal justice system. Basically, the Narcotics Law does not regulate criminal sanctions for children who abuse narcotics. However, as a reference, article 127 paragraph (1) of the Narcotics Law is elaborated with Article 81 paragraph (2). So that it can be concluded that the threat of criminal sanctions against narcotics abuse is a maximum of 6 years in prison.Keyword: Narcotics Abuse; Child.
